Terms of Use
Macotron is free, open-source software. The source code is licensed under the MIT License, and it comes with no warranty.
The website at macotron.statico.io (the “Site”) and the Macotron app (the “App”) are made by Ian Langworth, an individual (“I,” “me,” or “my”). These Terms of Use (“Terms”) govern your use of the Site and of the App you download from it or from the GitHub repository. By using the Site or the App, you agree to these Terms. You must be at least 18 years old to use the Site. If you do not agree to these Terms, do not use the Site or the App.
1. The MIT License
1.1 Source code. The source code of Macotron, including the App, its built-in plugins, and the files of the Site, is licensed under the MIT License. The LICENSE file in the repository has the full text.
1.2 The MIT License governs the code. Your rights to use, copy, modify, merge, publish, distribute, sublicense, and sell copies of the code come from the MIT License, not from these Terms. Nothing in these Terms limits the rights the MIT License gives you. If these Terms and the MIT License conflict about the code, the MIT License controls.
1.3 Third-party code. The App includes third-party components, such as QuickJS-ng and Sparkle, under their own licenses. The repository’s README lists them.
2. Using the Site
2.1 Access. Subject to these Terms, you may access and use the Site. Section 1 covers the code and files that the Site publishes.
2.2 Restrictions. You may not: (i) disrupt or overload the Site, or its update feed and blocklist; (ii) try to get unauthorized access to the Site or the systems that host it; or (iii) use the Site to break any law.
2.3 Changes to the Site and the App. I may modify, suspend, or discontinue the Site, the App, the update feed, or the blocklist, in whole or in part, at any time, with or without notice. I am not liable to you or any third party for any such modification, suspension, or discontinuation.
2.4 No support obligation. I have no obligation to provide support, maintenance, or updates for the Site or the App.
2.5 Names. The MIT License does not grant rights to the Macotron name or icon. Do not use them in a way that suggests that I made or endorse your product.
2.6 Feedback and contributions. If you share feedback or suggestions with me, you grant me a perpetual, irrevocable, worldwide, non-exclusive, fully paid, royalty-free license to use that feedback in any manner and for any purpose, without attribution. Unless you say otherwise in writing, code you contribute to the repository is licensed under the MIT License.
3. Privacy
The Privacy Policy describes what the Site and the App collect and how it is used, and it is part of these Terms. The Site uses no cookies or tracking technologies. If these Terms and the Privacy Policy conflict about personal information, the Privacy Policy controls.
4. Plugins and third-party services
4.1 Plugins have your access. An enabled plugin runs with all of Macotron’s access: your files, the shell, the network, and every macOS permission you grant. You are responsible for the plugins you enable, including the built-in plugins, community plugins, and plugins you write.
4.2 Community plugins. Community plugins are made by other people. I do not write, review, or endorse them, and I am not responsible for what they do.
4.3 Third-party services. The Site links to, and plugins connect to, services that other people operate, such as GitHub, Anthropic, OpenAI, Google, Apple, and weather and radio services (“Third-Party Services”). I do not control or endorse them, and I am not responsible for them. You use them at your own risk, and their own terms and privacy policies apply. When you use your own API key with an AI provider, your agreement with that provider governs that use, including any fees.
4.4 Release. To the fullest extent permitted by law, you release me and my successors and assigns from all claims, demands, and damages of any kind arising out of or related to plugins, other users, or Third-Party Services. If you are a California resident, you waive California Civil Code Section 1542, which provides: “A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor or released party.”
5. Indemnification
You agree to defend, indemnify, and hold me harmless from any claims and reasonable costs or attorneys’ fees arising out of (i) your use of the Site or the App, (ii) your violation of these Terms, or (iii) your violation of any applicable law or regulation. I may take control of the defense of any such claim at your expense, and you agree to cooperate with my defense. You agree not to settle any such claim without my prior written consent.
6. Disclaimers
THE SITE AND THE APP ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, I DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE SITE OR THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL CODE, OR THAT ANY PLUGIN WILL BEHAVE AS DESCRIBED. THE MIT LICENSE ALSO DISCLAIMS ALL WARRANTIES FOR THE CODE. WHERE APPLICABLE LAW REQUIRES WARRANTIES, THEY ARE LIMITED TO 90 DAYS FROM YOUR FIRST USE.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) I WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST DATA, COSTS OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SITE OR THE APP; AND (B) MY TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS IS LIMITED TO $50 USD. THE EXISTENCE OF MULTIPLE CLAIMS DOES NOT INCREASE THIS LIMIT. THE MIT LICENSE ALSO LIMITS LIABILITY FOR THE CODE.
8. Term and termination
These Terms remain in effect while you use the Site or the App. I may block your access to the Site at any time if I believe you have violated these Terms. Sections 1, 2.2 through 2.6, and 3 through 10 survive termination. Termination does not take away the rights the MIT License gives you to the code.
9. State-specific notices
9.1 California. Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice. The provider of the Site is Ian Langworth, 495 Jackson Street #1200, Oakland, CA 94607. The Site and the App are free of charge. To file a complaint about the Site, or to get more information about its use, contact me as described in Section 10.7. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, at 1625 N. Market Blvd. Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210.
9.2 State privacy laws. If you live in California, Colorado, Connecticut, Virginia, Nevada, or another state with a consumer privacy law, you may have additional rights about your personal information. The Privacy Policy explains them.
10. General
10.1 Changes to these Terms. I may update these Terms. When I do, I will change the date at the top of this page. The history of this page is public in the GitHub repository. If you continue to use the Site or the App after a change is posted, you accept the updated Terms.
10.2 Governing law. These Terms, and any dispute arising out of or related to these Terms, the Site, or the App, are governed by the laws of the State of California, without regard to its conflict-of-law principles. You and I consent to the exclusive jurisdiction and venue of the state courts located in Alameda County, California, and the federal courts for the Northern District of California. However, either party may bring an individual action in small claims court for claims within that court’s limits. The MIT License’s terms for the code are not changed by this section.
10.3 Export. You agree not to export, re-export, or transfer anything you get from the Site in violation of U.S. export control laws or the laws of other countries.
10.4 Electronic communications. Notices posted on the Site or in the GitHub repository satisfy any legal requirement for written notice.
10.5 Accessibility. I try to make the Site accessible to everyone, and to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. If you have difficulty using the Site, or have a suggestion, open an issue as described in Section 10.7.
10.6 Entire agreement. These Terms, the Privacy Policy, and the MIT License are the entire agreement between you and me about the Site and the App. If any provision of these Terms is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it valid, and the other provisions continue in effect. My failure to enforce a provision is not a waiver of it. The word “including” means “including without limitation.” You may not assign these Terms without my prior written consent; I may assign them freely.
10.7 Contact. Open an issue at github.com/statico/macotron/issues, or write to Ian Langworth, 495 Jackson Street #1200, Oakland, CA 94607. To report a vulnerability, follow the Security Policy.
